Terms Of Service

These terms are between Pineland, LLC (Pineland Technologies, "we") and the business that signs up for PooperScooperAI ("you"). By creating an account or using the service you agree to them on behalf of your business, and you confirm you may bind it.

PooperScooperAI connects to your Jobber account and, if you choose, your Facebook and Google accounts, and provides an inbox, a lead texting assistant, quote pages, mass texts and email, and reports. Features may change as the service improves; we will not remove a core feature you pay for without notice.

The service depends on Jobber, Twilio, the mobile carriers, Meta, Google and others. When one of them changes or limits its service, ours may change with it.

• Keep your sign-in details private. You are responsible for what happens under your account and your staff logins.
• Give us accurate business details, including for your texting registration.
• Tell us at hello@pooperscooperai.com if you think your account has been used without your permission.

• You are the sender of every text and email the service sends for you. You must have each recipient's consent for the messages you send them, as the law and the carriers require, and keep separate consent for marketing messages.
• The service enforces opt-outs, quiet hours and consent records; do not work around them.
• You are responsible for the content of your settings, your messages and what you tell the assistant is true about your service.

Do not use the service to:

• send messages to people who have not agreed to receive them, or after they have opted out;
• rotate numbers or domains to get around spam filters or carrier limits;
• claim your service kills, sanitizes, disinfects or neutralizes germs or bacteria, unless you are licensed to and we agree in writing;
• break any law, or anyone else's rights, or interfere with the service or other businesses on it.

We may pause sending on an account that breaks these rules, to protect your number and every other business's.

The assistant drafts and, if you let it, sends replies using your prices and settings. It can make mistakes. You decide whether it runs in draft mode or sends on its own, and you are responsible for what it sends in your name. It hands questions it should not answer to your office.

• The plan is $99 a month, billed in advance through Stripe.
• Texting is billed at cost: what Twilio charges for each text segment, picture message, phone number and carrier registration, itemized on your invoice.
• AI is billed by the token at $2.50 per million input tokens and $12.50 per million output tokens, with cached input at $0.25 per million read and $3.125 per million written.
• Usage is billed monthly in arrears. Prices may change with 30 days' notice by email.
• Taxes are added where they apply.

You can cancel at any time from the billing portal; the plan runs to the end of the month already paid, with no refund for part of a month. If a payment fails and is not fixed, sending and syncing stop, but your data is kept so you can pick up where you left off. We may close an account that breaks these terms.

Your data and your customers' data are yours. You give us permission to process them only to run the service for you, as the Privacy Policy describes. You can export your data or ask us to delete it.

The service is provided as it is and as available. We do not promise it will be uninterrupted or error-free, that every message will be delivered, or any particular number of leads or sales.

To the extent the law allows, neither of us is liable for indirect or consequential losses, lost profits or lost data, and our total liability for any claim is limited to what you paid us in the three months before it arose.

You will cover our reasonable costs if a claim is brought against us because of messages you sent without consent, content you supplied, or your breach of these terms.

We will email account owners at least 30 days before a material change takes effect. Using the service after that date means you accept the change.

These terms are governed by the laws of the State of Iowa, and any dispute goes to the state or federal courts in Linn County, Iowa.
